Beetelco, S.A. de C.V. (en adelante "Bee Telecom"), con domicilio en Av. Miguel Alemán No. 505, Santa María Xixitla, San Pedro Cholula, Puebla, C.P. 72760, pone a disposición del público el sitio de Internet www.beetelecom.mx, a través del cual ofrece información y contratación de sus servicios de telecomunicaciones, acceso a Internet, y Data Center (alojamiento, almacenamiento y procesamiento de información).

El acceso y uso del Sitio, así como la contratación de los servicios de Bee Telecom, implican la aceptación plena de los presentes Términos y Condiciones. Si el usuario no está de acuerdo con los mismos, deberá abstenerse de utilizar el Sitio y de contratar los servicios.

1. Marco normativo aplicable

Los presentes Términos y Condiciones se emiten conforme al marco jurídico mexicano vigente en materia de telecomunicaciones, protección de datos personales y protección al consumidor, entre otros:

  • Ley Federal de Protección de Datos Personales en Posesión de los Particulares (DOF 20 de marzo de 2025, reforma DOF 14 de noviembre de 2025);
  • Ley en Materia de Telecomunicaciones y Radiodifusión (DOF 16 de julio de 2025), que abrogó la Ley Federal de Telecomunicaciones y Radiodifusión de 2014 y creó la Comisión Reguladora de Telecomunicaciones ("CRT"), órgano desconcentrado de la Agencia de Transformación Digital y Telecomunicaciones ("ATDT"), que sustituyó al Instituto Federal de Telecomunicaciones a partir del 17 de octubre de 2025;
  • Ley Federal de Protección al Consumidor, particularmente su artículo 76 Bis en materia de transacciones por medios electrónicos;
  • Código de Comercio y demás disposiciones civiles y mercantiles aplicables.

2. Descripción de los servicios

Bee Telecom presta, entre otros, servicios de Data Center (alojamiento físico y/o virtual, almacenamiento y procesamiento de información) y servicios de conectividad y acceso a Internet, mismos que se formalizan mediante el contrato de prestación de servicios correspondiente, en el cual se detallarán el alcance, niveles de servicio (SLA), tarifas y demás condiciones específicas aplicables a cada cliente.

3. Derechos del usuario en materia de telecomunicaciones

Tratándose de los servicios de telecomunicaciones e Internet que presta Bee Telecom en su carácter de concesionario y/o autorizado, resultan aplicables, entre otros, los siguientes derechos del usuario reconocidos en la Ley en Materia de Telecomunicaciones y Radiodifusión:

  • Derecho a la protección de sus datos personales en términos de las leyes aplicables;
  • Derecho a elegir libremente a su proveedor de servicios y a la libre elección y no discriminación en el acceso a los servicios de Internet;
  • Derecho a conocer las condiciones comerciales establecidas en los modelos de contrato de adhesión, registrados ante la Procuraduría Federal del Consumidor ("PROFECO"), incluyendo a través de medios electrónicos;
  • Derecho a que se le provean los servicios conforme a los parámetros de calidad contratados o establecidos por la Comisión Reguladora de Telecomunicaciones;
  • Derecho a ser notificado, por cualquier medio, incluido el electrónico, con al menos treinta días naturales de anticipación, de cualquier cambio en las condiciones originalmente contratadas (tarifas, paquetes o servicios adicionales), a fin de que el usuario pueda exigir el cumplimiento forzoso del contrato, rescindirlo u otorgar su consentimiento expreso;
  • Derecho a cancelar el contrato sin necesidad de autorización del concesionario ni penalización alguna, una vez concluido el plazo pactado.

Las quejas relacionadas con el incumplimiento de estos derechos podrán presentarse ante la PROFECO, la Comisión Reguladora de Telecomunicaciones o la Secretaría de Gobernación, según corresponda a la naturaleza de la queja.

Nota: los servicios de Data Center prestados de forma independiente a la conectividad de red no constituyen, por sí mismos, un servicio público de telecomunicaciones concesionado; en tales casos, la relación contractual se rige preponderantemente por el Código de Comercio, la Ley Federal de Protección al Consumidor y el contrato de prestación de servicios respectivo, sin perjuicio de que, cuando dichos servicios se presten de manera convergente con conectividad o Internet, resulten aplicables las disposiciones de la Ley en Materia de Telecomunicaciones y Radiodifusión citadas en esta sección.

4. Transacciones por medios electrónicos

Conforme al artículo 76 Bis de la Ley Federal de Protección al Consumidor, en las transacciones que se celebren a través del Sitio, Bee Telecom se compromete a:

  • Utilizar la información proporcionada por el usuario de forma confidencial, sin transmitirla a terceros ajenos a la transacción, salvo autorización expresa del usuario o requerimiento de autoridad competente;
  • Emplear elementos técnicos que brinden seguridad y confidencialidad a la información proporcionada, e informar al usuario, previamente a la transacción, sobre las características generales de dichos elementos;
  • Proporcionar al usuario, antes de celebrar la transacción, su domicilio físico, números telefónicos y demás medios para presentar reclamaciones o solicitar aclaraciones (contacto@beetelecom.mx);
  • Evitar prácticas comerciales engañosas respecto de las características de los servicios ofrecidos;
  • Respetar el derecho del usuario a conocer toda la información sobre términos, condiciones, costos y cargos adicionales de los servicios ofrecidos.

Cuando el servicio contratado implique cobros automáticos recurrentes, Bee Telecom informará con claridad el monto y periodicidad del cobro, solicitará el consentimiento expreso del usuario, notificará con al menos cinco días naturales de anticipación a la renovación automática, y facilitará la cancelación inmediata del servicio, suscripción o membresía, en cumplimiento de las fracciones VIII y IX del artículo 76 Bis de la Ley Federal de Protección al Consumidor.

5. Obligaciones del usuario

El usuario se obliga a proporcionar información verídica, fidedigna, completa y exacta, y a abstenerse de realizar actividades que dañen, inutilicen o deterioren los sistemas informáticos del Sitio o la infraestructura de Bee Telecom, así como de utilizar el Sitio o los servicios contratados para fines ilícitos.

6. Propiedad intelectual

Todo el contenido, información, marcas y software disponibles en el Sitio son propiedad exclusiva de Bee Telecom o de sus licenciantes. Queda prohibida su reproducción, copia, distribución o modificación, total o parcial, sin autorización previa y por escrito.

7. Limitación de responsabilidad

Bee Telecom no garantiza que la información publicada en el Sitio se encuentre siempre actualizada o libre de errores, por lo que recomienda al usuario confirmar cualquier información relevante antes de tomar decisiones, escribiendo a contacto@beetelecom.mx. Bee Telecom no será responsable por fallas atribuibles a caso fortuito, fuerza mayor, o a circunstancias fuera de su control razonable.

Los alcances específicos de responsabilidad, niveles de servicio y penalizaciones aplicables a los servicios de Data Center y conectividad se establecerán en el contrato de prestación de servicios correspondiente.

8. Protección de datos personales

El tratamiento de los datos personales de los usuarios y clientes se rige por el Aviso de Privacidad de Bee Telecom, disponible en el Sitio, elaborado conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares.

9. Uso de cookies

El Sitio utiliza cookies y web beacons con fines estadísticos y de mejora del servicio, en los términos descritos en el Aviso de Privacidad.

10. Autoridades competentes

Para efectos de quejas, reclamaciones o procedimientos relacionados con los servicios de telecomunicaciones e Internet, resultan competentes, según corresponda: la Procuraduría Federal del Consumidor (PROFECO), la Comisión Reguladora de Telecomunicaciones (CRT) y, en su caso, la Secretaría de Gobernación. En materia de protección de datos personales, la autoridad competente es la Secretaría Anticorrupción y Buen Gobierno.

11. Modificaciones

Bee Telecom podrá modificar estos Términos y Condiciones en cualquier momento. Los cambios se darán a conocer a través del Sitio y serán aplicables a partir de su publicación.

12. Legislación aplicable y jurisdicción

Para la interpretación y cumplimiento de estos Términos y Condiciones, las partes se someten a la legislación federal mexicana aplicable y a los tribunales competentes en la ciudad de Puebla, Puebla, renunciando a cualquier otro fuero que pudiera corresponderles por razón de su domicilio presente o futuro.

TERMS AND CONDITIONS OF USE

Website www.beetelecom.mx — Beetelco, S.A. de C.V. ("Bee Telecom")

Beetelco, S.A. de C.V. (hereinafter "Bee Telecom"), with address at Av. Miguel Alemán No. 505, Santa María Xixitla, San Pedro Cholula, Puebla, C.P. 72760, makes available to the public the website www.beetelecom.mx, through which it offers information about and the contracting of its telecommunications, Internet access, and Data Center (hosting, storage, and information processing) services.

Access to and use of the Site, as well as the contracting of Bee Telecom's services, imply full acceptance of these Terms and Conditions. If the user does not agree with them, they must refrain from using the Site and from contracting the services.

1. Applicable regulatory framework

These Terms and Conditions are issued in accordance with the Mexican legal framework in force regarding telecommunications, personal data protection, and consumer protection, among others:

  • Federal Law on Protection of Personal Data Held by Private Parties (DOF March 20, 2025, amendment DOF November 14, 2025);
  • Telecommunications and Broadcasting Law (DOF July 16, 2025), which repealed the 2014 Federal Telecommunications and Broadcasting Law and created the Telecommunications Regulatory Commission ("CRT"), a decentralized body of the Digital Transformation and Telecommunications Agency ("ATDT"), which replaced the Federal Telecommunications Institute as of October 17, 2025;
  • Federal Consumer Protection Law, particularly its article 76 Bis regarding transactions conducted through electronic means;
  • Commercial Code and other applicable civil and commercial provisions.

2. Description of services

Bee Telecom provides, among others, Data Center services (physical and/or virtual hosting, storage, and information processing) and connectivity and Internet access services, which are formalized through the corresponding service agreement, detailing the scope, service levels (SLA), rates, and other specific conditions applicable to each client.

3. User rights regarding telecommunications

With respect to the telecommunications and Internet services provided by Bee Telecom in its capacity as a concessionaire and/or authorized provider, the following user rights recognized under the Telecommunications and Broadcasting Law apply, among others:

  • Right to the protection of personal data under applicable laws;
  • Right to freely choose one's service provider and to free choice and non-discrimination in access to Internet services;
  • Right to know the commercial conditions established in the standard-form contract models, registered with the Federal Consumer Protection Agency ("PROFECO"), including through electronic means;
  • Right to have services provided in accordance with the quality parameters contracted or established by the Telecommunications Regulatory Commission;
  • Right to be notified, through any means, including electronic, at least thirty calendar days in advance, of any change in the originally contracted conditions (rates, packages, or additional services), so that the user may demand enforcement of the contract, terminate it, or grant express consent;
  • Right to cancel the contract without requiring the concessionaire's authorization or any penalty, once the agreed term has concluded.

Complaints related to the breach of these rights may be filed with PROFECO, the Telecommunications Regulatory Commission, or the Secretariat of the Interior (Secretaría de Gobernación), as applicable depending on the nature of the complaint.

Note: Data Center services provided independently of network connectivity do not, by themselves, constitute a licensed public telecommunications service; in such cases, the contractual relationship is governed primarily by the Commercial Code, the Federal Consumer Protection Law, and the respective service agreement, without prejudice to the fact that, when such services are provided convergently with connectivity or Internet access, the provisions of the Telecommunications and Broadcasting Law cited in this section will apply.

4. Transactions conducted through electronic means

In accordance with article 76 Bis of the Federal Consumer Protection Law, in transactions carried out through the Site, Bee Telecom undertakes to:

  • Use the information provided by the user confidentially, without transmitting it to third parties unrelated to the transaction, except with the user's express authorization or as required by a competent authority;
  • Use technical elements that provide security and confidentiality for the information provided, and inform the user, prior to the transaction, of the general characteristics of such elements;
  • Provide the user, before completing the transaction, with its physical address, telephone numbers, and other means for filing claims or requesting clarifications (contacto@beetelecom.mx);
  • Avoid deceptive commercial practices regarding the characteristics of the services offered;
  • Respect the user's right to know all information regarding the terms, conditions, costs, and additional charges of the services offered.

When the contracted service involves recurring automatic charges, Bee Telecom will clearly disclose the amount and frequency of the charge, request the user's express consent, provide notice at least five calendar days prior to automatic renewal, and facilitate the immediate cancellation of the service, subscription, or membership, in compliance with sections VIII and IX of article 76 Bis of the Federal Consumer Protection Law.

5. User obligations

The user undertakes to provide truthful, reliable, complete, and accurate information, and to refrain from engaging in activities that damage, disable, or impair the Site's computer systems or Bee Telecom's infrastructure, as well as from using the Site or the contracted services for unlawful purposes.

6. Intellectual property

All content, information, trademarks, and software available on the Site are the exclusive property of Bee Telecom or its licensors. Their reproduction, copying, distribution, or modification, in whole or in part, is prohibited without prior written authorization.

7. Limitation of liability

Bee Telecom does not guarantee that the information published on the Site is always up to date or free of errors; therefore, it recommends that users confirm any relevant information before making decisions by writing to contacto@beetelecom.mx. Bee Telecom will not be liable for failures attributable to an act of God, force majeure, or circumstances beyond its reasonable control.

The specific scope of liability, service levels, and penalties applicable to Data Center and connectivity services will be set forth in the corresponding service agreement.

8. Protection of personal data

The processing of the personal data of users and clients is governed by Bee Telecom's Privacy Notice, available on the Site, prepared in accordance with the Federal Law on Protection of Personal Data Held by Private Parties.

9. Use of cookies

The Site uses cookies and web beacons for statistical purposes and to improve service, under the terms described in the Privacy Notice.

10. Competent authorities

For purposes of complaints, claims, or proceedings related to telecommunications and Internet services, the following authorities have jurisdiction, as applicable: the Federal Consumer Protection Agency (PROFECO), the Telecommunications Regulatory Commission (CRT), and, where applicable, the Secretariat of the Interior. Regarding personal data protection, the competent authority is the Secretariat for Anti-Corruption and Good Governance.

11. Modifications

Bee Telecom may modify these Terms and Conditions at any time. Changes will be announced through the Site and will apply from the date of publication.

12. Applicable law and jurisdiction

For the interpretation and performance of these Terms and Conditions, the parties submit to the applicable Mexican federal legislation and to the competent courts of the city of Puebla, Puebla, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
